UK Ruling Shows Tool For Taming Multijurisdictional Disputes

A recent U.K. High Court judgment, PJSC National Bank Trust and PJSC Otkritie Financial Corp. v. Mints, in the English branch of one such dispute suggests that parties should be prepared for judges to use the full set of tools at their disposal, including fee-shifting and perhaps other sanctions as well, to mitigate, as far as possible, the risk of discordant outcomes across courts and tribunals concurrently considering the same or similar factual allegations.
