Welch Says Insurers Must Defend Juice Marketing Suits

Law360, New York (December 8, 2009, 6:53 PM EST) -- Welch Foods Inc. filed a lawsuit Tuesday claiming that its insurers have a duty to defend and indemnify the company in two pending suits over the juice giant's marketing of a white-grape and pomegranate juice.

The juice maker lodged its suit against Zurich American Insurance Co. and American International Group Inc.'s National Union Fire Insurance Co. of Pittsburgh in the U.S. District Court for the District of Massachusetts seeking declaratory judgment against the insurers and alleging breach of contract.
