Dillard's Opposes General Growth's Ch. 11 Plan

Law360, New York (December 10, 2009, 1:07 PM EST) -- Dillard's Inc. has objected to bankrupt mall owner General Growth Properties Inc.'s reorganization plan, saying that it impairs the retailer's contractual rights to its occupancy of dozens of GGP-owned malls in the South and West.

In an objection filed Wednesday in the U.S. Bankruptcy Court for the Southern District of New York, Dillard's said GGP's Chapter 11 plan treats Dillard's as an unimpaired creditor, even though the plan affects contracts Dillard's holds, impacts proofs of claims Dillard's has filed against non-debtor malls and wrongly grants exclusive...
