Fla. Appeals Court Orders Hearing On Bid To DQ Akerman

Law360 (May 19, 2021, 4:17 PM EDT) -- Florida's Third District Court of Appeal on Wednesday ordered a trial court to hold an evidentiary hearing in a foreclosure matter after the defendant claimed his conversation about the case with his sister, a partner at the opposing party's counsel Akerman LLP, should disqualify the firm.

Defendants Joseph P. Klock Jr. and Susan M. Klock — both attorneys at Rasco Klock Perez & Nieto in Miami — had appealed an October order that denied their motions to disqualify Akerman from representing Citibank in the underlying foreclosure matter out of the Eleventh Judicial Circuit Court.
