Law360, New York (December 14, 2009, 5:17 PM EST) -- By paying out $4 million to settle an underlying personal injury suit before the U.S. Court of Appeals for the Second Circuit had an opportunity to weigh in on the case, Lumbermens Mutual Casualty Co. may have sunk its appeal of a district court ruling that found it liable as an excess insurer to RGIS Inventory Specialists and Enterprise Rent-A-Car.
