High Court Sweeps Away Challenge To Chrysler Sale

Law360, New York (December 14, 2009, 6:58 PM EST) -- The U.S. Supreme Court on Monday dismissed an appeal brought by Indiana pension funds that said the former Chrysler LLC's deal to sell assets to Italy's Fiat SpA for $2 billion in a shotgun marriage attended by Uncle Sam did not generate a proper recovery for secured creditors.

In doing so the nation's highest court vacated an Aug. 5 precedential opinion issued by the U.S. Court of Appeals for the Second Circuit, which affirmed the asset sale but left the door open for possible future claims....
