Merrill Lynch Fights To Keep NJ Suit In Federal Court

Law360, New York (December 16, 2009, 4:43 PM EST) -- Merrill Lynch & Co. has asked a federal appeals court not to remand a lawsuit brought by the state of New Jersey alleging the bank misrepresented its financial health when it sold $300 million in preferred stock to the state's investment division.

Following a judge’s order sending the case back to the state court last month, Merrill lodged an appeal Tuesday to the U.S. Court of Appeals for the Third Circuit to keep the case in the U.S. District Court for the District of New Jersey....
