AstraZeneca Loses Appeal In Generic Prilosec Feud

Law360, New York (December 16, 2009, 2:28 PM EST) -- The U.S. Court of Appeals for the Federal Circuit has rejected AstraZeneca AB’s appeal of a lower court decision that Dr. Reddy's Laboratories Ltd.’s generic version of popular over-the-counter antacid Prilosec did not infringe two patents.

In a one-sentence order issued Tuesday, the appeals court upheld the earlier determination that Dr. Reddy’s generic Prilosec did not violate AstraZeneca’s patents.

The order did not offer any further details on the judges’ reasons for affirming the trial court’s ruling.
