AT&T Wins Case Over Phone Bill Surcharge

Law360, New York (December 16, 2009, 4:26 PM EST) -- A federal judge has handed a victory to AT&T Mobility, formerly known as Cingular Wireless LLC, in a proposed class action accusing the cell phone provider of breaching its contract with customers by billing a surcharge to cover taxes assessed by Washington state.

Judge Thomas Zilly of the U.S. District Court for the Western District of Washington on Tuesday granted AT&T summary judgment and dismissed the suit with prejudice.
