Judge Chucks Key Claim From Okla. Poultry Suit

Law360, New York (December 16, 2009, 5:18 PM EST) -- Ruling that bird manure isn't “solid waste” under federal environmental law, a judge has dismissed a key claim in the state of Oklahoma's pollution lawsuit against several poultry producers.

Judge Gregory Frizzell of the U.S. District Court for the Northern District of Oklahoma on Tuesday dismissed the state's claim that poultry litter from the plants of Tyson Foods Inc. and other major poultry companies constituted solid waste, the Oklahoma attorney general's office confirmed Wednesday.
