Uninsured Patients' Class Action Gets Green Light

Law360, New York (November 23, 2006, 12:00 AM EST) -- A Superior Court judge has given the go-ahead to a class action lawsuit brought by uninsured patients against Scripps Health for allegedly excessive fees, denying the California hospital system’s motion to dismiss.

The suit was originally filed by Phillip Franklin, an uninsured man treated by Scripps and then charged an allegedly excessive amount for the hospital’s services.

Franklin filed suit in July on behalf of himself and a proposed class of thousands of uninsured patients treated at Scripps hospitals since July 19, 2002.
