Calif. Court Nixes $34M Verdict In Novell Bonus Spat

Law360, New York (December 21, 2009, 6:48 PM EST) -- A California appeals court has overturned a $33.5 million verdict against Novell Inc. in a dispute brought by software developers alleging the technology company failed to pay bonuses due under its agreement to purchase DeFrame technology from TriPole Corp.

The California State Court of Appeal's Fourth Appellate Division on Thursday overturned the September 2007 jury verdict, finding that the lower court improperly imposed massive sanctions on Novell for handing over key evidence that had previously been thought to be lost after the trial had already begun....
