Judge Nixes Iraq Contractor’s Bid To Toss OT Claims

Law360 (December 22, 2009, 3:51 PM EST) -- A federal judge has denied military contractor Lear Siegler Services Inc.’s bid to dismiss overtime claims from a proposed breach of contract class action brought against the company by Iraq-based employees.

In a memorandum decision and order issued Friday, Magistrate Judge Mikel H. Williams of the U.S. District Court for the District of Idaho denied LSI’s motion for partial summary judgment, saying there were issues of material fact as to whether the plaintiffs received approval from supervisors to work unpaid overtime.
