Hartford Must Cover Medical Card 'Damages': Judge

Law360, New York (December 22, 2009, 5:24 PM EST) -- A Texas federal judge has ordered Hartford Accident & Indemnity Insurance Co. to cover defense costs for health care provider The Capella Group Inc. in underlying litigation arising from personal and advertising injury, finding that the plaintiffs in the underlying case indeed were seeking damages as defined by the policies.

Judge John McBryde issued the ruling Monday in the U.S. District Court for the Northern District of Texas, finding in favor of Capella, which provides medical discount cards under the moniker Care Entree.
