NY Court Boots Ga. Man's Lipitor Case Against Pfizer

Law360, New York (December 22, 2009, 6:31 PM EST) -- A Georgia man's product liability suit over Pfizer Inc.'s blockbuster drug Lipitor belongs in his home state, a New York appeals court has affirmed, rejecting another state court's “mass tort litigation” approach that allowed nonresidents to file suit in the Empire State.

The New York Supreme Court's Appellate Division, First Department, affirmed on Tuesday a lower court's decision to grant Pfizer's motion to dismiss Charles M. Wilson's complaint on the ground of forum non conveniens.
