Liberty Units Balk At Coverage For Marathon Death Suit

Law360, New York (December 23, 2009, 2:30 PM EST) -- Two Liberty Mutual Insurance Co. units have lodged a declaratory judgment suit against Marathon Oil Corp., seeking a decree that they need not defend or indemnify the oil giant in an underlying suit alleging wrongful death of a worker.

The units, Netherlands Insurance Co. and Indiana Insurance Co., filed their complaint Tuesday in the U.S. District Court for the Southern District of Illinois, contending that insurance policies they issued to Blackhawk Engineering Inc. did not extend to Marathon.
