BP Express FLSA Suit Survives, Heads To Tenn.

Law360, New York (January 6, 2010, 2:27 PM EST) -- A federal judge has kept alive a wage-and-hour suit filed by BP Express Inc. truck drivers, but allowed the trucking company to move the suit from Georgia to Tennessee based on a clause in the drivers' contracts.

In a ruling Monday in the U.S. District Court for the Southern District of Georgia, Judge B. Avant Edenfield interpreted the trucking company's motion to dismiss as a motion to transfer, and saw no reason not to move the putative class action, which accuses the trucking company of denying...
