Mass. Health System Fired Exec For FCA Concerns, Suit Says

By Brian Dowling (October 22, 2021, 5:08 PM EDT) -- A western Massachusetts hospital system that overbilled Medicare by $5 million for hyperbaric oxygen therapy fired its brand-new chief financial officer for voicing alarm about the potential for more widespread False Claims Act lawbreaking, according to a federal suit filed Friday.

Sean Fitzpatrick said in his retaliation and wrongful termination suit against Berkshire Medical Systems Inc. that his concerns about errors and other billing discrepancies displeased others in the hospital system, which includes Berkshire Medical Center in Pittsfield and Fairview Hospital in Great Barrington.
