Kodak ERISA Partial Termination Suit Tossed

Law360, New York (January 14, 2010, 5:04 PM EST) -- A federal judge has thrown out a former Eastman Kodak Co. worker's case seeking payment of benefits for hundreds of the technology firm's retirement plan participants in the wake of what the employee alleged was a partial termination of the plan.

Judge David G. Larimer of the U.S. District Court for the Western District of New York on Tuesday tossed plaintiff Michael Scanlan's case, saying the worker had failed to adequately state a claim under the Employee Retirement Income Security Act.
