Judge Recommends Dismissing 28 Claimants In BP Spill Suit

By Nathan Hale (October 26, 2021, 10:27 PM EDT) -- A Florida federal magistrate said Tuesday that he agreed with BP that claims from 28 plaintiffs should be dismissed from consolidated litigation stemming from the 2010 Deepwater Horizon oil spill because they previously opted to seek recovery through workers' compensation.

In his report and recommendation, U.S. Magistrate Judge Gary R. Jones found that the district court should grant BP PLC's motion for summary judgment in these cases to comply with a settlement agreement the oil giant reached to cover all cleanup workers' claims. U.S. District Judge M. Casey Rodgers will make a final ruling on the motion.
