Holocaust Suits Against Insurer Preempted: 2nd Circ.

Law360, New York (January 15, 2010, 6:43 PM EST) -- A federal appellate court ruled on Friday that insurance coverage claims against Assicurazioni Generali SpA related to Holocaust-era policies are preempted under New York state law by the foreign policy of the United States.

The U.S. Court of Appeals for the Second Circuit affirmed a grant of summary judgment for the Italian insurer, which held that resolution claims brought by appellants Thomas Weiss, Erna Birnbaum Gottesman and others belong in the International Commission on Holocaust Era Insurance Claims.
