Deposition OK'd In Union Carbide Mesothelioma Suit

Law360, New York (January 21, 2010, 4:59 PM EST) -- Dealing a blow to Union Carbide Corp., a California appeals court has ruled that the deposition of a man who died from mesothelioma allegedly caused by asbestos can be part of the record in a wrongful death lawsuit.

In a Jan. 15 decision the California Court of Appeal for the Second Appellate District said the deposition of John H. Washington Jr. can be admitted in a suit filed by his widow, Helen P. Washington, and his children. The appellate court also said there was no evidence...
