Restaurateurs Ask Texas Judge To Block Tipped Worker Rule

By Michelle Casady (December 20, 2021, 4:41 PM EST) -- The Restaurant Law Center and the Texas Restaurant Association have filed an emergency request asking a Texas federal judge to temporarily block the U.S. Department of Labor's new rule that cracks down on the volume of work tipped workers may perform while being paid subminimum tipped wage.

The groups urged U.S. District Judge Robert Pitman on Friday to grant their emergency motion for a preliminary injunction before the rule goes into effect on Dec. 28, arguing the restaurants they represent, already beleaguered by the pandemic, will suffer irreparable harm without court intervention.
