News-Press’ Rights Trump Journalists’: 9th Circ.

Law360, New York (January 26, 2010, 7:02 PM EST) -- The U.S. Court of Appeals for the Ninth Circuit has upheld a district court ruling denying a group of journalists reinstatement at a California newspaper after they had been fired for taking part in union activities in part directed at limiting the editorial control of the paper's publisher.

In a split 2-1 ruling Tuesday the appellate panel said the district court was correct in determining that the First Amendment rights of newspapers — in this specific case Ampersand Publishing LLC and the Santa Barbara News-Press —...
