Wal-Mart Hit With Consumer Suit Over Service Plans

Law360, New York (January 27, 2010, 5:36 PM EST) -- A New Jersey shopper has launched a putative class action accusing Wal-Mart Stores Inc. of fraud and breach of contract for selling customers at its Sam's Club stores service plans on “as-is” items that are explicitly excluded from coverage under the plan.

Sam's Club customer William Hayes filed suit Tuesday in the U.S. District Court for the District of New Jersey alleging the warehouse retailer deceptively markets the service plans to consumers who purchase as-is items even though the plan does not cover such items....
