Foot Locker Denied Immediate Appeal Of FLSA Suit

Law360, New York (January 29, 2010, 5:49 PM EST) -- A federal judge has denied Foot Locker Inc.'s bid to allow an immediate appeal of his order to grant conditional collective certification in a Fair Labor Standards Act suit, saying he would subsequently reconsider certification anyway.

In an order Tuesday, Judge J. Curtis Joyner of the U.S. District Court for the Eastern District of Pennsylvania said there was nothing so unique about the case that would justify the immediate intervention of an appellate court.
