Attorneys Fear Return Of Outside Compliance Monitors

Law360, New York (March 4, 2010, 5:47 PM EST) -- A proposal to amend U.S. sentencing guidelines to call for an independent compliance monitor for all companies sentenced to probation would likely do more harm than good, compliance and criminal defense attorneys say.

While the use of compliance monitors has died down from the post-Enron heyday, the government's stated desire to bring them back has left some wondering whether anything has been learned in recent years.
