NetApp Data Storage Suit Stayed For Patent Appeal

Law360, New York (February 16, 2010, 4:39 PM EST) -- A federal judge has stayed software company Network Appliance Inc.'s patent infringement lawsuit against rival Sun Microsystems Inc. over file storage technology while NetApp appeals a decision by the U.S. Patent and Trademark Office that one of the patents-in-suit is invalid.

Magistrate Judge Elizabeth D. Laporte of the U.S. District Court for the Northern District of California ruled Thursday that the suit should be stayed as to U.S. Patent Number 5,819,292, currently the only NetApp patent at issue in the suit, to avoid needless expense....
