Insurers' Win In Fortney Coverage Suit Reversed

Law360, New York (February 16, 2010, 3:59 PM EST) -- A federal appeals court has overturned a lower court’s decision that three insurers did not have a duty to defend Fortney & Weygandt Inc. in third-party litigation arising out of a construction contract dispute, remanding the case to district court with instructions to award the general contractor summary judgment on its duty to defend claim.
