Conn. Law Firm Wins Reversal Of Expert Contact Sanctions

By Clarice Silber (May 27, 2022, 2:22 PM EDT) -- The Connecticut Appellate Court has reversed the sanctions against a law firm that was accused of having improper communications with the defense's medical expert in a case regarding motorist benefits involving Liberty Mutual Insurance Co.

Judge Michael Sheldon wrote in an opinion set to be officially released on Tuesday that because the state's "rules of practice do not clearly prohibit ex parte communications between an attorney for a party and a testifying expert witness previously disclosed by an opposing party," the court would reverse the trial court's judgment against Brignole Bush & Lewis LLC.
