Cuomo Suit Targeting Madoff Cohort Merkin Lives On

Law360, New York (February 18, 2010, 3:30 PM EST) -- Ezra Merkin has lost a bid to dismiss New York Attorney General Andrew Cuomo's lawsuit alleging his investment company Gabriel Capital Corp. funneled funds into pal Bernard Madoff’s Ponzi scheme.

Judge Richard Lowe denied Merkin’s motion to dismiss in a ruling filed Wednesday in the New York County Supreme Court.

Merkin moved to dismiss the suit in July, but the judge found that Cuomo had adequately pled violations of the Martin Act, New York General Business Law and the Not-for-Profit Corporation Law, as well as breach...
