A&K's Appeal Of General Growth $400M DIP Nixed

Law360, New York (February 19, 2010, 6:39 PM EST) -- A federal judge has dismissed A&K Endowment Inc.'s appeal of General Growth Properties Inc.'s $400 million debtor-in-possession financing, finding that the bankrupt mall owner and its lender negotiated the loan in good faith.

On Wednesday, Judge John G. Koeltl of the U.S. District Court for the Southern District of New York dismissed as moot A&K's appeal of the bankruptcy court's order giving the green light to the financing.
