E.U. Ruling Sets Stage For Flood Of Pension Suits

Law360 (December 15, 2006, 12:00 AM EST) -- A landmark European court ruling on a Dutch farming company’s dispute with the French government has paved the way for European pension funds to receive hundreds of millions of dollars in reclaimed taxes.

In a Dec. 14 decision, the European Court of Justice ruled that France illegally charged the Dutch firm a so-called withholding tax on dividends paid from its French subsidiaries to its headquarters in the Netherlands.
