Pfizer's Bid To Toss Protonix Medicaid Suits Denied

Law360, New York (February 24, 2010, 6:45 PM EST) -- A federal judge has denied Pfizer Inc.'s efforts to dismiss two consolidated whistleblower suits accusing the drugmaker of overcharging state Medicaid programs hundreds of millions of dollars for the acid reflux treatment Protonix.

Judge Douglas Woodlock of the U.S. District Court for the District of Massachusetts on Wednesday rejected Pfizer's motion to dismiss the suits.

According to the suits, between 2000 and 2006, Wyeth gave substantial discounts on oral and intravenous versions of Protonix to thousands of hospitals that purchased both drugs as part of a...
