Class Cert. Granted In Construction FLSA Case

Law360, New York (March 5, 2010, 5:46 PM EST) -- A judge has conditionally certified a Fair Labor Standards Act collective action made up of current and former construction workers at Raines & Welsh & Sons Inc. in a lawsuit that accuses the construction company of improperly withholding overtime compensation.

In an order filed Wednesday, Judge Harold Baer Jr. of the U.S. District Court for the Southern District of New York denied the plaintiffs' request for the class period to date back to May 4, 2006, instead setting the date at July 8 of that year....
