Federal Circuit Remands Case Over On-Sale Doctrine

Law360 (December 19, 2006, 12:00 AM EST) -- The U.S. Court of Appeals for the Federal Circuit has reversed a summary judgment ruling in favor of software company BEA Systems Inc. after concluding the lower court erred in its interpretation of the on-sale bar doctrine.

The case was appealed from the U.S. District Court for the Northern District of California, where a recent BEA acquisition, Plumtree Software Inc., sued rival Datamize LLC for summary judgment of noninfringement in December 2002.
