Philips Retiree Benefits Class Action Foiled Again

Law360, New York (March 5, 2010, 4:16 PM EST) -- A federal judge has again thrown out a class action accusing Philips Electronics North America Corp. of violating employee benefits laws by canceling retirees' lifetime health plans after a subsidiary filed for bankruptcy.

Judge Patrick J. Duggan of the U.S. District Court for the Eastern District of Michigan dismissed the lawsuit with prejudice Wednesday, ruling that Philips was “not obligated to provide continuing health insurance benefits to plaintiffs and did not violate [the Employee Retirement Income Security Act] when those benefits were terminated.”
