Judge Rejects Ivax Challenges To Depomed Patents

Law360, New York (December 21, 2006, 12:00 AM EST) -- A California federal judge has sided with the patent interpretations of specialty pharmaceutical company Depomed Inc. in its infringement case against Ivax Corp. over its diabetes treatment Glumetza.

U.S. District Judge Charles Breyer entered a Markman ruling in agreement with Depomed on two patents in the U.S. District Court for the Northern District of California on Wednesday.

The Menlo Park, Calif.-based company lodged the suit against Ivax back in January, alleging that Ivax’ extended-release metformin hydrochloride tablets infringe Depomed’s pair of patents. The patents deal with...
