Korean Rubber Co. Loses Bid To Revive Antitrust Suit

Law360, New York (March 16, 2010, 2:42 PM EDT) -- A federal appeals court has upheld the dismissal of Korea Kumho Petrochemical Co. Ltd.'s antitrust case accusing a Solutia Inc. subsidiary of trying to keep the company out of the U.S. market for rubber and plastics.

The U.S. Court of Appeals for the Ninth Circuit said Monday that the district court was correct to toss Korea Kumho's third amended complaint against Flexsys America LP after the rubber company failed to allege competition in the market had been injured.
