Claims Pared In Dey, Sepracor IP Fight Over Brovana

Law360, New York (March 18, 2010, 2:40 PM EDT) -- Sepracor Inc. and Dey LP have agreed to dismiss a range of individual patent claims in their battle over Sepracor's rollout of chronic obstructive pulmonary disease drug Brovana.

Dey agreed Wednesday to drop prosecution of over 30 claims of one of the patents it asserted against Sepracor in the U.S. District Court for the Southern District of New York.

Sepracor, for its part, said it would drop its declaratory judgment counterclaims relating to those same claims of U.S. Patent Number 6,814,953.
