Perdue Beats Action Over Chickens With Extra Giblets

Law360, New York (March 19, 2010, 5:22 PM EDT) -- A federal judge has dismissed a class action alleging Perdue Farms Inc. stuffed extra hearts, gizzards, livers and necks into whole chickens, forcing consumers to pay more for chicken because it is priced by the pound.

Judge Virginia Kendall of the U.S. District Court for the Northern District of Illinois threw out the case with prejudice Wednesday, saying the allegations were not specific enough to survive dismissal.
