Affinity Logistics Drivers' Overtime Claims Get The Boot

Law360, New York (March 24, 2010, 3:52 PM EDT) -- A federal judge has tossed a lawsuit brought by former delivery drivers for Affinity Logistics Corp. who accused the company of misclassifying drivers as independent contractors to avoid paying overtime.

Following a December bench trial, Judge Janis Sammartino issued a memorandum Monday in the U.S. District Court for the Southern District of California finding that the drivers were indeed properly classified under the Fair Labor Standards Act as independent contractors.
