KV Pharmaceutical ERISA Class Action Tossed

Law360, New York (March 26, 2010, 7:02 PM EDT) -- A federal judge has thrown out a consolidated class action accusing KV Pharmaceutical Co. of violating the Employee Retirement Income Security Act through its handling of an employee investment plan.

Judge Carol E. Jackson found on Wednesday that plaintiffs Harold S. Crocker Jr. and Anna Bodnar had failed to state a claim under the Iqbal standards, granting motions to dismiss by KV as well as the board members and financial officers also named in the complaints.
