Cephalon Off-Label Class Action Won't Be Reopened

Law360, New York (March 31, 2010, 12:27 PM EDT) -- A federal judge has declined to reopen a putative class action filed by a group of municipal benefit funds over Cephalon Inc.’s alleged promotion of several drugs for off-label uses.

The Central Regional Employees Benefit Fund and the other New Jersey municipal fund plaintiffs lost their motion to revive the case and file an amended complaint in the U.S. District Court for the District of New Jersey on Monday.
