1st Circ. Affirms Toss Of Raytheon Copyright Suit

Law360, New York (March 31, 2010, 7:07 PM EDT) -- A federal appeals court has affirmed the dismissal of a copyright suit Airframe Systems Inc. brought against Raytheon Co. over source code, finding the suit was precluded when Airframe chose not to appeal an earlier suit it lost that concerned the same matter.

The suit, which also named L-3 Communications Corp., was not sufficiently distinguishable from the earlier suit, which named L-3 but not Raytheon, the U.S. Court of Appeals for the First Circuit said Wednesday.
