Rite Aid Loses Summary Judgment Bid In OT Suit

Law360, New York (April 5, 2010, 2:48 PM EDT) -- A federal judge has denied Rite Aid Corp.'s motion for summary judgment in a proposed overtime class action by a former store manager, saying a more fully developed factual record is needed to resolve the issues presented in the case.

Judge Paul G. Gardephe of the U.S. District Court for the Southern District of New York ruled on Wednesday denied Rite Aid's motion for partial summary judgment with regard to the plaintiff's Fair Labor Standards Act overtime claims.
