Gemini Loses Summary Bid In Deductible Spat

Law360, New York (April 20, 2010, 4:56 PM EDT) -- A federal judge has rejected Gemini Insurance Co.'s bid for summary judgment in a putative class action in which Consolidated Fiberglass Products Co. has accused the insurer of breaching a contract by demanding deductibles to which it is not entitled.

Judge Marilyn Huff of the U.S. District Court for the Southern District of California signed off on an order denying Gemini's summary judgment motion on Monday.

Consolidated Fiberglass brought the suit on behalf of parties that entered into a comprehensive general liability insurance policy with Gemini....
