Coke Gets ‘Original Formula’ Marketing Suit Tossed

Law360, New York (April 29, 2010, 2:33 PM EDT) -- The Coca-Cola Co. has successfully axed a lawsuit claiming that it unfairly marketed its Coca-Cola Classic soft drink as “original formula” despite having substituted high-fructose corn syrup for the ordinary table sugar it used when the drink was introduced.

Judge Patrick Murphy issued an order Tuesday in the U.S. District Court for the Southern District of Illinois granting summary judgment to Coca-Cola and dismissing the case with prejudice.

Jeffrey Millar of Brent Coon & Associates, who represents the plaintiffs, said they intend to appeal the ruling....
