Medicaid Drivers Seek Class Status In FLSA Suit

Law360, New York (May 4, 2010, 5:43 PM EDT) -- Four Medicaid transportation drivers have moved for class certification in a collective action alleging their employer, Irving Holdings Inc., withheld overtime compensation and incorrectly classified employees as independent contractors.

In a motion filed Monday in the U.S. District Court for the Northern District of Texas, plaintiffs Robert L. Spence, Patsy A. Warren, Brenda J. Lowrance and Richard D. Devaney asked the court to conditionally certify a class and to authorize them to send notice of the opt-in action to some 400 potential class members.
