Black & Decker Wins Dismissal Of Overtime Action

Law360, New York (May 13, 2010, 2:41 PM EDT) -- A federal judge has tossed a nationwide collective action accusing Black & Decker (U.S.) Inc. of failing to pay its retail specialists for time worked off the clock, finding that the plaintiff had not shown he worked overtime.

Judge Michael A. Telesca of the U.S. District Court for the Western District of New York granted summary judgment Wednesday to Black & Decker, ending a lawsuit brought on behalf of about 750 retail specialists across the U.S.
